The law concerns much over the “cruelty” done by the husband against his wife. That does not mean that the husband alone do cruelties against the wife, and not the wife. Wives are also equally committing cruelties against their husbands with the connivance of her relatives and others. Here the earlier remain as an offence under section 498A of IPC under the heading “Cruelty by husband or relatives of husband”. But the later viz. cruelty by wife against husband does not come within the purview of Offences relating to Marriage under IPC. However “Cruelty” committed by either of the spouse against each other remains a good ground under the personal laws to claim dissolution of marriage (divorce). Even filing false case under section 498A IPC by wife to harass her husband and his family members for the sake of luring money is also a cruelty against husband, which is a very good ground for husband to claim divorce. Except for the purpose of claiming divorce, there is no direct penal provision in law alike section 498A, to protect the husband from the cruelty of his wife and to punish her.
